said he can’t come, he’ll have to talk
another time. He said, “He’s been shot

That was when you were first aware of
what occurred down there. You had no
relatives living near you, you were
scared when you called, potentially in
danger. Nothing further, nothing further.

Did James Bare go to Glen Daniels or
did he drive directly to Cabell Heights?

Did he pull up behind Chief Deputy

STATEMENT OF CHRIS HATFIELD

DATE: July 4, 2006

Time: 2:38 a.m.

Prsent:

Corporal Bare

Chris Hatfield

BARE: Mr. Hatfield, you're neighbors with the Webb's. Is that correct?

HATFIELD: Right.

BARE: You live right beside of 'em?

HATFIELD: Correct.

BARE: What did you hear tonight?

HATFIELD: I heard him over and there playing his music and let off a few rounds. That's about it, just shooting rounds.

BARE: Did you see him shooting any?

HATFIELD: No. Didn't see him shooting, he was letting off some firecrackers and then shot the gun a few times.

BARE: So, you don't know where he was shooting the gun at?

HATFIELD: No, we was over here.

BARE: Okay. Could you tell me if it was behind the house, there in the driveway or what?

HATFIELD: I couldn't tell, I don't, you know-

BARE: That's okay.

HATFIELD: - I just heard him over here shooting.

BARE: About how many times, do you have any idea?

HATFIELD: Ten, I don't know. I don't know I was half asleep, you know, after we went over there.

BARE: Okay. Now --

HATFIELD: I didn't know if that was just him or somebody else shooting, you know, it's the 4th of July I don't know.

BARE: That's okay. Did you see anything else, did you hear anything else outside, anybody talking?

HATFIELD: No. We was over here talking to him and then we went inside. He was over there with firecrackers and, you know, he started shooting a gun a few times and that was it.

BARE: When was the last time you talked to him?

HATFIELD: Nine o'clock or ten o'clock, I don't know.

BARE: Nine or ten - he was out there that entire time?

HATFIELD: He was out there rotating his tires, you know, working on his truck.

BARE: Could you tell if he had been drinking?

HATFIELD: I guess so I didn't see him I guess he had been I don't know.

BARE: Well, when you talked to him last?

HATFIELD: I didn't see him drink anything, I just -

BARE: Oh, I see what you're saying.

HATFIELD: I didn't, you know.

BARE: Okay.

HATFIELD: I didn't see him drink or anything he acted like he may have been having a few beers or something, I don't know.

BARE: Okay. But I mean, he wasn't acting radical?

HATFIELD: He wasn't all crazy, no, he was just - like I said he was just changing his tires on his truck and everything, he had just got done with that.

BARE: Have you ever had any problems with him or anything?

HATFIELD: No, they've been great neighbors.

BARE: No problems with him drinking or anything?

HATFIELD: No.

BARE: Get rowdy or anything?

HATFIELD: No, just playing his music every once in a while, you know.

BARE: Okay.

HATFIELD: He hadn't, you know, he hadn't been drinking, that's what I thought - I don't know if he was or not, because he hadn't been drinking for a long time, you know, he just --

BARE: Oh, really?

HATFIELD: Yeah, he had been quite for a long time.

BARE: OH, has he?

HATFIELD: Yeah.

BARE: Okay. So that's about all you heard thought, I mean?

HATFIELD: Yeah, he was letting off some firecrackers too, hee had been doing that for about a week, you know, just letting a few firecrackers off. I didn't know what all, you know.

BARE: Anything else you can tell me?

HATFIELD: No, that's about it.

BARE: I'll go ahead and end this then at 2:40

STATEMENT OF KRISTI HATFIELD

DATE: July 4, 2006

TIME: 2:32 A. M.

PRESENT:

Corporal Bare

Kristi Hatfield (K-r-i-s-t-i)

BARE: Ms. Hatfield, you're neighbors with the Webb's here. Is that correct?

HATFIELD: Yes.

BARE: What went on tonight?

HATFIELD: He had been drinking a little bit and had been --

BARE: Let me try that again. Okay. I'm sorry, go ahead Ms. Hatfield.

HATFIELD: He had been drinking and shot off a couple of rounds. He had firecrackers too that he had shot off but we didn't think anything of it. The dogs were barking so I told my husband he needed to shut the dogs up and we saw a flashlight moving and thought that Rob was over there just messing with the dogs and then he saw you all over there.

BARE: Did you guys see what happen?

HATFIELD: No. We just heard some gunshots, but we thought it was him.

BARE: Okay. Was your husband outside when the shots were fired?

HATFIELD: No.

BARE: So you had heard just him firing up firecrackers and --

HATFIELD: Uh-huh, firecrackers and we had seen him shoot a couple of times. He was shooting up in the air, but the last 30 minutes or so we were in the bed we didn't see him -- we didn't see anything.

BARE: What was he shooting up in the air, do you know what it was?

HATFIELD: I don't know what it was I just saw him with a gun shooting up in the air, I don't now what kind it was.

BARE: Was it a pistol like this or a long gun?

HATFIELD: I was thinking he had a pistol, but I don't know.

BARE: That's okay, if you don't know that's okay.

HATFIELD: I just know he was shooting up in the air.

BARE: About how many rounds do you know, how many times did he fire?

HATFIELD: He fired five times - five rounds three times - about fifteen times. But they weren't like one right after another, it's been over in like the last two or three hours he had done that.

BARE: Okay.

HATFIELD: Does that make sense, five rounds, three times?

BARE: Yes. So you think he might have fired fifteen rounds?

HATFIELD: I'm thinking probably about that, that's how many I remember hearing because I remember thinking he is going to reload. It took him a while so it was like I said it was over two or three hours.

BARE: Okay. Did you by chance hear anything prior to that; prior to the officer's getting here?

HATFIELD: No. We were actually over here talking to him about 10 or 10:30 or 11 o'clock. We were over in the driveway talking to him -- didn't hear anything.

BARE: Okay. What condition was he in?

HATFIELD: He was a little --

BARE: A little tipsy?

HATFIELD: He was a little tipsy, yeah.

BARE: Okay.

HATFIELD: Just a little bit. He was talking, his daughter was outside with us. He was putting the tire on his truck.

BARE: Has he ever been known to be a problem when he was drunk?

HATFIELD: He can be a little rowdy, just loud music, firecrackers, you know, just being loud, but no, nothing.

BARE: No altercations with your husband or anything?

HATFIELD: No. No, never --

BARE: Okay.

HATFIELD: -- with me or his wife or anything like that.

BARE: Okay. Prior to - you say there was flashlights, you saw flashlights?

HATFIELD: Uh-huh (yes). Yeah, my husband saw flashlights so we thought Rob was messing with the dogs just making them bark.

BARE: What, did he see this through the window or something?

HATFIELD: Through our window, through our bedroom window which is on the backside of the house.

BARE: Okay. And then there was I guess some more shots after that?

HATFIELD: No. We didn't even get up. I remember hearing the two shots, but we just thought it was him and we didn't - he just happen to get up to shut the dogs up because they had been barking for about 30 minutes and he saw the flashlights.

BARE: Did you hear anybody say anything outside or anything?

HATFIELD: No.

BARE: How far - I guess you were in bed?

HATFIELD: Yes. Our window is on the far side, but it's on this back side of the house.

BARE: So it's on the opposite side?

HATFIELD: Uh-huh (yes).

BARE: Okay. Anything else you can tell me?

HATFIELD: No, I think that's it.

BARE: Okay

HATFIELD: Do you need me to go get my husband; do you need to talk to him?

BARE: Yeah. I'll go ahead and end this at 2:36
